According to Peter Cook, executive director of the Ontario Waste Management Association (OWMA), it appears that IC&I waste is moving to Michigan disposal sites under the new system that requires a paper declaration with each vehicle. The declaration certifies that the load has been checked for materials prohibited from disposal at Michigan landfills. Michigan landfills are enforcing the paper requirements and to date Michigan’s Department of Environmental Quality (DEQ) has not been inspecting either the Michigan landfill records or individual vehicles from Ontario.

The determination of de minimus quantities of prohibited waste could be a major issue when inspections commence. Michigan DEQ has been active at landfills in western Michigan (not utilized by Ontario) inspecting wastes from other states, namely Indiana. U.S. EPA recently gave Michigan funds to pay for aggressive inspection of Canadian waste vehicles.
